I don't think that everyone using the phrase intends on those children (the bullies) being prosecuted for murder. While I haven't said it that way myself, their point is to draw a line between the actions of one and the actions of another.
While I very firmly believe that people are in control of their own actions and that such language is inexact, I also think that it's very important that people understand the repercussions of their actions. Maybe the victim was incredibly sensitive and one snide remark sent him over the edge, but more likely it was a systematic expression of hatred - gleeful abuse intended to harm ... just not intended to harm them to death. Whoops, we done too good.
If it takes having their noses rubbed in the consequences of their actions (so that they don't go around earnestly singing the lyrics to The Freshmen, heh), so be it.
